1. Acceptance of Terms

By enrolling in 33Hugs (“Service”), you agree to these Terms of Service and our Privacy Policy, and you authorize us to send SMS/MMS messages to the mobile number you provide. If you do not agree, please do not opt in.

2. Service Description

33Hugs delivers one motivational SMS message per day for a 33-day cycle (One-Time Plan) or on an ongoing basis (Subscription Plans). Messages are intended for general inspiration and mental-wellness support, not as medical, psychological, or professional counseling.

3. Eligibility and Opt-In

You must be at least 18 years old and the authorized user of the mobile device you register. By opting in, you consent to receive recurring messages; message frequency and opt-out instructions are disclosed at signup.

4. Opt-Out and Help

To cancel your daily messages, you can text STOP at any time. Please see our Cancel Subscription instructions on all your opt-out options. For further assistance, contact us via our website. Carriers are not liable for delayed or undelivered messages, and message/data rates may apply according to your plan and provider.

5. Third-Party Charges

You are responsible for any fees or charges imposed by your wireless carrier for sending or receiving SMS/MMS messages.

6. Billing and Renewal

- **One-Time Plan**: Single payment grants access for a 33-day cycle; no auto-renewal.

- **Subscription Plans**: Monthly or annual fees are billed in advance on a recurring basis until you pause or cancel.

You may pause or cancel at any time; however, no refunds will be issued for partial billing periods.

7. No Professional Advice

The content provided by 33Hugs is for motivational purposes only and does not constitute medical, legal, financial, or professional advice. Always seek qualified professionals for such guidance.

8. Intellectual Property

All content, materials, and assets on the 33Hugs website and in our SMS service, including text, design elements, graphics, and the 33Hugs logos, are owned by 33Hugs or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our content without our prior written consent.

All other trademarks, service marks, trade names, and logos appearing in our service, as well as images not owned by 33Hugs, remain the property of their respective owners. If you believe any content infringes your rights, please contact us as set out in Section 14.

9. Limitation of Liability

To the fullest extent permitted by law, 33Hugs and its affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of—or inability to use—the Service, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless 33Hugs, its officers, and employees from any claims, losses, or liabilities arising out of your breach of these Terms or your use of the Service.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via SMS or email at least 30 days before they take effect. Continued use after updates constitutes acceptance.

12. Termination

We reserve the right to suspend or terminate your access for violation of these Terms or for any behavior we deem harmful to other users or our operations.

13. Governing Law

These Terms are governed by the laws of Ontario, Canada, excluding conflict-of-law provisions. Any disputes shall be heard exclusively in the courts of Ontario.
